2. THESE TERMS
2.1 These Terms and Conditions govern the sale of goods through our website.
2.2 By placing an order, you agree to be bound by these Terms.
2.3 These Terms form a legally binding contract between you and us.
3. PRODUCTS
3.1 All items are pre loved, antique, or vintage pieces and are sold as individual, one of a kind items.
3.2 Items will show signs of age, wear, or previous use.
3.3 We take reasonable care to ensure descriptions, photographs, and measurements are accurate.
3.4 Colours and condition may vary slightly due to lighting and screen differences.
3.5 Listing photographs form part of the item description.
3.6 By placing an order, you confirm that you have reviewed all photographs, descriptions and measurements and accept the item’s condition as described.
4. ORDERING AND CONTRACT FORMATION
4.1 Orders are placed via our website using secure payment processing provided by Stripe.
4.2 A contract is formed when you receive an order confirmation email from us.
4.3 We reserve the right to cancel or refuse any order before collection or delivery, including where:
• the item is no longer available
• there is a pricing or listing error
• fraudulent or unauthorised activity is suspected
4.4 If we cancel your order, a full refund will be issued.
4.5 Orders may be subject to verification checks before release.
4.6 We reserve the right to refuse or cancel any order where we reasonably suspect misuse of the website or fraudulent activity.
4.7 We do not guarantee that the website or listings will be error-free or continuously available and reserve the right to correct errors or omissions.
5. PRICE AND PAYMENT
5.1 All prices are stated in GBP (£).
5.2 Payment must be made in full at the time of purchase.
5.3 Items will not be released until payment has cleared.
5.4 We reserve the right to dispute chargebacks where goods have been supplied in accordance with these Terms.
6. COLLECTION
6.1 Collection is free from our Eco Living shop. Tuesday to Saturday 9.30-4.30
6.2 Collection must be arranged within 14 days of purchase.
6.3 Customers are responsible for ensuring items can be safely transported.
6.4 Staff may assist with loading but cannot dismantle or assemble items.
6.5 By placing an order for collection, you confirm that access to the property is suitable and that the item will fit into the intended space.
6.6 Customers are expected to inspect items at the point of collection and notify us of any issues at that time where reasonably possible.
7. DELIVERY
7.1 We offer a flat rate delivery service:
• £30 per order
• Available within Hastings and Rother
• Typically completed within 5–10 working days
7.2 We will contact you to arrange a delivery slot between Tuesday to Saturday 9.30-4.30
7.3 Customers must ensure:
• safe and suitable access to the delivery address
• that the item will fit through doorways, stairways, and into the intended space
7.4 By placing an order for delivery, you confirm that access to the property is suitable and that the item will fit into the intended space.
7.5 We do not:
• remove existing furniture
• dismantle or assemble items
7.6 Customers are expected to inspect items at the point of delivery and notify us of any issues at that time where reasonably possible.
7.7 Failed delivery
If delivery cannot be completed due to access issues, absence, or incorrect information:
• a redelivery fee equal to the original delivery charge (£30) will apply, or
• the order may be treated as cancelled under clause 10
8. THIRD PARTY COURIERS
8.1 We do not offer national delivery.
8.2 Customers may arrange their own courier at their own risk and expense.
8.3 You must notify us before booking a courier.
8.4 Items must be collected within 14 days of purchase between Tuesday to Saturday 9.30-4.30
8.5 Risk passes at the point the item is released to your courier.
8.6 We are not responsible for loss or damage during third party transport.
9. DISTANCE SELLING AND CANCELLATION RIGHTS
9.1 We only accept orders within the United Kingdom.
9.2 Your rights under the Consumer Contracts Regulations 2013 apply.
9.3 Important – nature of goods
Due to the unique and pre owned nature of our items, the right to cancel may be affected once goods have been collected or delivered, particularly where handling beyond what is necessary to inspect the goods has occurred.
9.4 By purchasing, you acknowledge:
• items are individually photographed and described
• condition and wear are part of the product’s character
• transport of returned goods carries risk of damage
9.5 Orders may be cancelled for a full refund before:
• collection is arranged, or
• delivery is scheduled
10. RETURNS AND REFUNDS
10.1 This policy operates alongside your statutory rights under the Consumer Rights Act 2015.
10.2 We do not accept returns for change of mind after collection or delivery.
10.3 You may be entitled to a refund if an item is significantly not as described, including:
• undisclosed structural damage
• major faults not visible in listing images
• materially incorrect measurements
10.4 Normal wear and tear (including marks, scratches, fading, and age related characteristics) is not a fault.
10.5 To request a refund:
• customers should contact us within 48 hours of collection or delivery
• provide clear photographs and a description
10.6 If a refund is approved:
• the item must be returned, or
• we may arrange collection at our discretion
10.7 We reserve the right to inspect items before issuing a refund.
11. STORAGE AND UNCOLLECTED ITEMS
11.1 Items must be collected within 14 days unless agreed otherwise.
11.2 After this period:
• storage charges will be applied at a reasonable rate to cover handling and space, or
• we reserve the right to cancel the order and refund less reasonable costs
11.3 If items remain uncollected for more than 28 days, we reserve the right to treat the goods as abandoned and may resell or dispose of them. Any refund will be at our discretion and may be reduced to reflect storage and administrative costs.
12. RISK AND OWNERSHIP
12.1 Ownership transfers upon collection, delivery, or courier release (as applicable), provided full payment has been received.
12.2 Risk transfers:
• on collection, when loaded into your vehicle
• on delivery, once HFS has delivered to your address
• on courier collection, when handed to your courier
13. LIABILITY
13.1 Nothing in these Terms excludes liability where it would be unlawful to do so.
13.2 To the extent permitted by law, our total liability to you shall not exceed the purchase price of the item.
13.3 We are not liable for:
• damage occurring after risk has transferred
• access related delivery issues
• third party courier actions
• delays outside our reasonable control
13.4 We are not liable for failure or delay in performance caused by events outside our reasonable control, including but not limited to severe weather, transport disruption, or operational issues beyond our control.
14. DATA PROTECTION
14.1 We process personal data in accordance with applicable data protection law.

15. GOVERNING LAW
These Terms are governed by the laws of England and Wales, and disputes shall be subject to the jurisdiction of the English courts.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

HFS EcoLiving – Delivery & Returns Policy
1. Overview
Eco‑Living items are one‑of‑a‑kind, pre‑loved furniture and homeware pieces donated to Hastings Furniture Service (HFS).
All items are sold as seen and may show signs of age or use. We aim to describe and photograph each item accurately so customers can buy with confidence.
2. Delivery Options
2.1 Free Collection from Store
Customers are welcome to collect items directly from our store
• Collection must be arranged within14 days of purchase.
• Staff can assist with loading but cannot dismantle or assemble items.
• Customers are responsible for ensuring the item fits safely into their vehicle.
2.2 No National Delivery by HFS (Courier Option Available)
HFS does not offer national delivery directly due to the size and nature of the items.
Customers who require delivery outside our local area may arrange their own courier at their own expense.
If choosing this option:
• Please notify us before booking the courier.
• Couriers must collect within 14 days of purchase.
• HFS cannot accept responsibility for any damage caused during third‑party transport.
• Items will be released only once the courier provides proof of collection.
3. Returns Policy
3.1 No Returns for Change of Mind
We do not accept returns if a customer changes their mind after purchase.
This is because:
• items are one‑off
• transport costs are high
• items may be damaged in return transit
Customers are encouraged to review photos, descriptions and measurements carefully before purchasing.
3.2 Refunds for Items Not as Described
If an item is significantly not as described, customers may request a refund.
Examples include:
• undisclosed structural damage
• major faults not visible in photos
• incorrect measurements
To request a refund:
• Contact us within 48 hours of collection or delivery
• Provide photos and a clear description of the issue
If the refund is approved:
• Customers may return the item to the shop
• Or HFS may collect the item if necessary
3.3 Wear and Tear
Eco‑Living items are pre‑loved.
Minor marks, scratches, fading or age‑related wear are considered normal and are not grounds for a refund.
